Licensed Versus Unlicensed Temporaries on New Home Sales Sites

Can an unlicensed temporary legally work as a host or hostess on new home sales sites as a salesperson?

No. Per California Business & Professions Code 10131(a), it is illegal to sell or offer to sell, buy or offer to buy, solicit prospective sellers or purchasers of, solicit or obtain listings of or negotiate the purchase, sale or exchange of real property or a business opportunity without a license.

What are the capabilities and limitations of an unlicensed temp?

Per California Business & Professions Code 10131 (a–e), 10131.2, 3 & 6, the only thing an unlicensed temp can legally do is "point and greet." They can't quote prices, demonstrate products, discuss financing, or do anything that would construe them as being a salesperson. Licensed salespersons from Real Estate Temps can do everything from sourcing traffic and prospect qualification to product demonstration.

Is there liability associated with using an unlicensed temporary salesperson?

Yes, because answering a simple question could result in the unlicensed temp going beyond their legal perimeters. Per California Business & Professions Code 10139, any person acting as a real estate broker or real estate salesperson without a license shall be guilty of a public offense punishable by a fine of not exceeding $10,000, or by imprisonment in the county jail for a term not to exceed six months, or by both fine and imprisonment, or if a corporation, be punished by a fine not exceeding $50,000. In addition, builders that use unlicensed temps could be subject to litigation arising from inappropriate actions and/or statements by an unlicensed temp on a new home site. All temporaries from Real Estate Temps are licensed real estate salespersons. Prior to sending a salesperson out on assignment, we conduct reference checks, license verification and skills evaluations.

What type of real estate training do unlicensed temps receive?

Most unlicensed temps have not received any real estate sales training or education in real estate law. Therefore, they do not understand the critical path associated with new home sales. Can an unlicensed temp be converted into a full-time salesperson?

Unlicensed temps cannot be converted into full-time salespersons unless they become licensed. Real Estate Temps' clients have the option of trial employment prior to hiring a full-time salesperson.

What is the cost difference between an unlicensed and a licensed temp?

There is a negligible difference in the cost between a licensed and unlicensed temporary.

Nevada

Can an unlicensed temporary legally work as a host or hostess on new home sales sites as a salesperson?

No. Per Nevada Revised Statute (NRS) 645.230, it is illegal to use unlicensed temps as salesperson: "It is unlawful to engage in the business of, act in the capacity of, advertise or assume to act as a real estate salesman within the State of Nevada without first obtaining the appropriate license from the real estate division." Since all temporaries provided by Real Estate Temps are licensed real estate agents in the state of Nevada, they are completely legal.
